COPYRIGHT AGREEMENT (public offer)

By the fact of submission of the article and accompanying files (hereinafter referred to as the ‘Work’) for publication in the journal, the author (as well as all authors of this work, if it is created in joint authorship) agrees to grant the publisher the exclusive and perpetual right to use the work on a royalty-free basis (exclusive, perpetual and royalty-free license) on the territory of Russia and foreign countries to the following extent and scope for:

  • publication of the Work in paper and/or electronic format, production of reprints of the work, posting it on the Internet, both in open and paid access, sending metadata of the Work or full texts to various indexing databases and repositories;
  • reproduction of the Work, i.e. making one or more copies of the Work or part thereof in any material form, including in the form of sound or video recording. At the same time, recording of the Work on an electronic medium, including recording into computer memory, shall also be deemed reproduction;
  • the distribution of the Work by sale or other alienation of its original or copies;
  • public display of the Work, i.e. any demonstration of the original or a copy of the Work either directly or on a screen by means of film, slide, television frames or other technical means, as well as demonstration of separate frames of an audio-visual Work without observing their sequence either directly or by means of technical means in a place open to the public or in a place where a significant number of persons not belonging to the usual family circle are present, regardless of whether the Work is perceived or not at the place of its demonstration or elsewhere simultaneously with the demonstration of the work;
  • import-export of the Work or parts thereof for any lawful purpose, whether paid or unpaid, of the original or copies of the work for distribution purposes;
  • translation or other adaptation of the Work.
  • making the Work available to the public in such a way that any person may have access to the work from any place and at any time of their own choosing (public communication);
  • publishing the Work or parts thereof in various collections of similar works;
  • granting the rights provided for in this Article, in full or in part, to third (natural and legal) persons, either on a paid or free-of-charge basis.

By submitting the manuscript for consideration to the Editorial Team of the journal, the authors accept the terms of the COPYRIGHT AGREEMENT (public offer) for the publication of the article in the scientific journal "VOPROSY ONKOLOGII".

ANSMO «Questions of Oncology», represented by Director Stanislav Viktorovich Prudius, acting on the basis of the Charter (hereinafter referred to as the ‘Publisher’), on one side, offers to an indefinite circle of persons (hereinafter referred to as the ‘Author’), on the other side, hereinafter collectively referred to as the ‘Parties’, to conclude this agreement (hereinafter referred to as the ‘Agreement’) on the publication of scientific materials (hereinafter referred to as the ‘Article’) in the scientific journal "Voprosy Onkologii" (hereinafter referred to as the ‘Journal’) on the following terms and conditions.

1. General provisions

This Agreement, in accordance with par. 2 of Art. 437 of the RF Civil Code, constitutes a public offer (hereinafter referred to as the ‘Offer’), the full and unconditional acceptance (acceptance) of which, in accordance with Art. 438 of the RF Civil Code, is considered to be the submission of materials by the Author by uploading them to the network electronic article submission system located in the corresponding section of the Journal's website at the URL: https://voprosyonkologii.ru/index.php/journal/about in the information and telecommunication network Internet (hereinafter referred to as the ‘Internet’).

In accordance with the current legislation of the Russian Federation regarding compliance with copyright to electronic information resources, materials of the website, electronic journal, or project may not be reproduced in full or in part in any form (electronic or printed) without the prior consent of the authors and the Editorial Team of the Journal. Authors retain copyright and grant the journal right of first publication with the work simultaneously licensed under a Creative Commons Attribution License (CC BY-NC-ND 4.0) that allows others to share the work with an acknowledgement of the work's authorship and initial publication in this journal.  The Journal is registered with the Federal Service for Supervision of Communications, Information Technology and Mass Media (Roskomnadzor).

2. Terms used in the Agreement

Author - a natural person (persons) whose creative work resulted in the creation of the Article.

Acceptance of the Offer - full and unconditional acceptance of the Offer on the terms specified in clause 3 of the Agreement (the Author accepts the Offer by submitting an application to the Publisher - uploading the Article and accompanying materials to the network electronic article submission system for consideration, located in the corresponding section of the Journal's website at URL: https://voprosyonkologii.ru on the Internet).

Journal – the scientific journal "Voprosy Onkologii".

Application - an electronic request from the Author to the Publisher for the publication of the article in the Journal by uploading the Article and accompanying materials to the network electronic article submission system for consideration, located in the corresponding section of the Journal's website https://voprosyonkologii.ru on the Internet.

Publisher - ANSMO «Questions of Oncology», the founder and publisher of the Journal.

Article Metadata - materials in Russian and English intended for inclusion in scientific citation databases in accordance with the original version of the Article: article title; author information (full name, affiliation of each author with postal address, contact information (email) for each author); abstract; keywords; subject heading: UDC or other library and bibliographic classification and subject indexes; bibliography (list of references).

Offer - this document (offer to the Author) for the publication of the Article by placing it on the Journal's website at URL.

Publication - placement of the Article in the Journal.

Editorial Team of the Journal - the creative team responsible for preparing the Journal for publication.

Editorial Board - an advisory body under the Editorial Board of the Journal.

Article - a result of fundamental and applied scientific research in the form of a scientific material, scientific review material, scientific report, literature review on specific topics of scientific research, historical reference dedicated to the figures of Russian and foreign science, submitted by the Author for publication in the Journal.

Parties - the Author and the Publisher.

Requirements for Articles - requirements to the materials published in the Journal, placed in the "Author Guidelines" section of the Journal website at URL: https://voprosyonkologii.ru/index.php/journal/about/submissions on the Internet.

Service - placement (publication) of the Article in the Journal based on the Author's Application.

3. Subject of the Agreement (Offer)

3.1 Under this Agreement, the Author grants to the Publisher on a royalty-free basis for the term of validity of the copyright provided by the legislation of the Russian Federation, a non-exclusive licence to use the Article created by the Author for publication in the Journal.

3.2. The rights to use the Article granted under this Agreement include, but are not limited to:

  • reproduce the Article or its separate parts, as well as metadata of the article in Russian and English, in any material form, including in print and electronic format, as a separate work in journals and/or databases (local or on the Internet) of the Publisher and/or other parties, at the discretion of the Publisher;
  • distribute of the Article or a separate part thereof, as well as metadata of the Article in Russian and English in any medium as part of the Journal and/or databases of the Publisher or other persons, at the discretion of the Publisher, or as an independent work worldwide on open access or subscription basis without payment of remuneration to the Author;
  • make the Article or a separate part of it, as well as the metadata of the Article in Russian and English languages available to the public in such a way that any person can access the Article from any place and at any time at his/her own discretion (including via the Internet);
  • grant authorisation to third parties to use the Article and its separate parts, as well as the metadata of the Article in Russian and English languages, with notification of the Author thereof by posting the relevant information on the Journal's website without payment of remuneration to the Author;
  • perform adaptation, including translation of the Article (including into foreign languages), and use of the adapted (translated) Article in the above-mentioned ways;
  • other rights not directly transferred to the Publisher under this Agreement, including patent rights to any processes, methods, or techniques, and others described by the Author in the Article, as well as rights to trademarks, shall be retained by the Author.

3.3. The territory where the rights to the Article may be exercised is not limited.

3.4. This Agreement comes into effect upon the submission of the Article to the Journal – by uploading the Article and accompanying materials to the network electronic article submission system for consideration, located in the corresponding section of the Journal's website at URL: https://voprosyonkologii.ru/ on the Internet (hereinafter referred to as the ‘Article Submission’).

3.5. The rights shall be transferred by the Author to the Publisher on the royalty-free basis, and publication of the Article in the Journal shall not entail any financial contributions to the Author.

3.6. In the event that the Publisher decides to refuse publication of the Article in the Journal, this Agreement shall become null and void. The decision to refuse publication shall be communicated to the Author at the email address provided in the Application.

3.7. The Publisher undertakes to provide the Author with services related to the publication of the Article on the Journal's website at URL: https://voprosyonkologii.ru/ on the Internet during the term of this Agreement.

4. General Terms and Conditions of Service Provision

4.1. The Publisher provides services to the Author only under the following conditions:

  • The Author has provided all materials corresponding to the Offer's requirements by uploading the article;
  • The Author has Accepted the Offer.

4.2. The services are provided to the Author on a royalty-free basis.

4.3. In the event that materials are submitted by the Author in violation of the rules and requirements of this Offer, the Publisher reserves the right to refuse their publication.

4.4. The Publisher shall not be held responsible during the term of the Agreement for the unauthorized use by third parties of the data provided by the Author.

5. Rights and Obligations of the Parties

5.1. The Author guarantees:

  • That they are the rightful owner of the exclusive rights to the article; the rights granted to the Publisher under this Agreement have not been previously transferred and will not be transferred to third parties until the publication of the Article by the Publisher in the Journal;
  • That the Article contains all required references to cited authors and/or publications (materials) as provided by current copyright legislation;
  • That the Author has obtained all necessary permissions for the use of the results, facts, and other borrowed materials used in the Article, the rights to which the Author does not own;
  • That the Article does not contain materials that are not subject to publication in open print according to current legislation of the Russian Federation, and its publication and distribution will not lead to the disclosure of secret (confidential) information (including state secrets);
  • That the Author has informed other Co-Authors regarding the terms of this Agreement and has obtained the consent of all Co-Authors to enter into this Agreement on the terms and conditions stipulated by the Agreement.

5.2. The Author undertakes to:

  • Submit the manuscript of the Article in accordance with the Requirements for articles specified on the Journal's website at URL: https://voprosyonkologii.ru/index.php/journal/about/submissions;
  • Not to use the electronic copy of the Article prepared by the Publisher for commercial purposes and in other publications without the consent of the Publisher;
  • During the preparation of the Article for publication, the Author agrees to:
    • incorporate into the text of the Article corrections suggested by reviewers and accepted by the Editorial Team of the Journal, and/or, if necessary, to finalise the Article at the request of the Publisher and the Editorial Team;
    • read the proofreading of the Article within the terms provided by the Journal publication schedule;
    • make only the minimum necessary edits to the proofreading of the Article, which are associated with correcting errors made in the original Article and/or making actual and momentary changes.

5.3. The Author has the right to:

  • Transfer to third parties an electronic copy of the published Article provided to him by the Publisher under clause 5.4 of this Agreement, in whole or in part, for inclusion of the Article in databases and repositories of scientific information in order to promote academic or scientific research or for information and educational purposes, while ensuring that references to the Author, the Journal and the Publisher are provided.

5.4. The Publisher undertakes to:

  • publish the Author's Article in the Journal in print and electronic form in accordance with the terms of this Agreement;
  • at the discretion of the the Editorial Team of the Journal, if necessary, provide the Author with proofreading of the layout of the Article and make reasonable edits suggested by the Author;
  • provide the Author with an electronic copy of the published Article to the Author's email address within 15 working days from the date of publication of the Journal issue;
  • observe the Author's rights provided by applicable legislation, as well as protect them and take all necessary measures to prevent infringement of copyright by third parties.

5.5. The Publisher has the right to:

  • carry out technical and literary editing of the Article, which does not alter it (the main content);
  • conduct an expert review of the Article and suggest necessary changes to the Author, until the fulfilment of which the Article will not be published in the Journal;
  • in case of any subsequent authorised use of the Journal and/or the Article (including any separate part or fragment thereof) by the Author (and/or other persons), require such parties to provide references to the Journal, the Publisher, the Author or other copyright holders, the title of the Article, the number of the Journal’s issue and the year of publication, as specified in the Journal;
  • place preliminary and/or advertising information about the upcoming publication of the Article in the media and other information sources;
  • establish rules (conditions) for the acceptance and publication of materials in the Journal. The Editorial Board of the Journal, headed by the Editor-in-Chief, has the exclusive rights to select and/or reject materials submitted to the Editorial Team of the Journal for publication. The manuscript (physical carrier) sent by the Author to the Editorial Team of the Journal is not subject to return. The Editorial Team of the Journal does not engage in correspondence regarding the rejection of the Article by the Editorial Board of the Journal;
  • temporarily suspend the provision of services to the Author under the Agreement for technical, technological, or other reasons preventing the provision of services, till such reasons are eliminated;
  • suspend the provision of services under the Agreement unilaterally out of court in cases where:
    • in case the Article does not correspond to the theme of the Journal (or any of its parts), or the material submitted is insufficient for independent publication, or the formatting of the Article does not meet the specified requirements;
    • in case the Author breaches other obligations accepted in accordance with the Offer;
    • make changes to the Offer in accordance with the procedure established by the Offer.

5.6. In all cases not stipulated and not provided for in this Agreement, the Parties shall be guided by the current legislation of the Russian Federation.

6. Acceptance of the Offer and Conclusion of the Agreement. Term of the Agreement

6.1. This Agreement enters into force upon its conclusion when the Author accepts the Offer by submitting an application to the Publisher - Uploading the Article, and is valid for 5 years.

6.2. The Author's acceptance of the Offer creates an Agreement concluded in writing (Art. 438 and 1286.1 of the RF Civil Code) on the terms and conditions of the Offer.

6.3. If neither Party sends written notice of termination of the Agreement to the other Party no later than two months before the end of the prescribed five-year term, then the term of the Publisher's rights to the Works shall be automatically extended for a similar period. The number of extensions is unlimited.

6.4. The term of the Agreement cannot exceed the term of the exclusive rights to the Article in accordance with the legislation of the Russian Federation.

6.5. Upon the transfer (alienation) of the exclusive right to the Work by the Author to a third party, this Agreement shall not be terminated.

7. Procedure for Modification and termination of the Agreement

7.1. The Publisher has the right to unilaterally amend the terms of this Agreement, notifying the Author through the Journal's website or by sending a notification via email to the Author's email address specified in the Author's Application, at least 10 (ten) calendar days before the changes take effect. The changes come into force from the date specified in the relevant notification.

7.2 In case of disagreement of the Author with the changes in the terms of this Agreement, the Author has the right to send a written notice of cancellation of this Agreement to the Publisher by uploading the notice to the network electronic system of acceptance of articles for consideration, placed in the corresponding section of the Journal's website at URL: voprosyonkologii.ru in the Internet or by sending the notice to the official e-mail address of the Editorial Team of the Journal, specified on the website of the Journal "Voprosy Oncologii" in the Internet.

7.3. This Agreement may be terminated prematurely:

  • by mutual agreement of the Parties at any time;
  • on other grounds stipulated by this Agreement.

7.4. The Author shall have the right to unilaterally withdraw from this Agreement by sending the Publisher a corresponding notice in writing at least 60 (sixty) calendar days before the expected date of publication of the Author's article in the Journal.

7.5 Termination of the Agreement for any reason shall not release the Parties from liability for violations of the Agreement terms and conditions arising during the term of its validity.

8. Liability

8.1. Parties shall be liable for failure to fulfil or improper fulfilment of their obligations under the Agreement in accordance with the current legislation of the Russian Federation.

8.2. All information provided by the Author must be accurate. The Author is responsible for the accuracy and completeness of the information provided to the Publisher. In the event of the use of inaccurate information received from the Author, the Publisher shall not be liable for any negative consequences resulting from its actions based on the inaccurate information provided.

8.3. The Author is solely responsible for compliance with the requirements of the legislation of the Russian Federation on advertising, protection of copyright and neighbouring rights, protection of trademarks and service marks, and on the protection of consumer rights.

8.4. The Publisher shall not be liable under the Agreement for:

  • any actions resulting directly or indirectly from the Author's actions;
  • any losses incurred by the Author regardless of whether the Publisher could have foreseen the possibility of such losses or not.

8.5. The Publisher shall be released from liability for breach of the terms of the Agreement if such breach is caused by force majeure, including actions of public authorities (including adoption of legislative acts), fire, flood, earthquake, other natural disasters, electricity and/or network failures, strikes, civil unrest, riots, or any other circumstances.

9. Dispute Resolution Procedure

9.1. Disputes and disagreements shall be resolved by the Parties through negotiations, and in case of failure to reach an agreement - in accordance with the current legislation of the Russian Federation.

9.2. In the event of unresolved disagreements between the Parties, disputes shall be settled in court at the location of the Publisher in accordance with the current legislation of the Russian Federation.

10. Other terms and conditions

10.1 Any notices, messages, requests, etc., shall be sent to the Publisher. (except for documents that must be sent in the form of true originals in accordance with the laws of the Russian Federation) shall be deemed received by the Author if they have been transmitted (sent) by the Publisher through the website of the Journal (including by publication), by fax, by e-mail specified in the Application and by other communication channels. The Parties recognise the legal validity of notices, messages, requests, etc. transmitted (sent) by the above methods.

10.2. In the event of claims being brought against the Publisher related to the infringement of exclusive copyright and other intellectual property rights of third parties in connection with the creation of the Article or in connection with the conclusion by the Author of this Agreement, the Author undertakes to:

  • promptly, upon receipt of notification from the Publisher, take measures to settle disputes with third parties, if necessary, to enter into litigation on the side of the Publisher and take all actions dependent on him to exclude the Publisher from the defendants;
  • compensate the Publisher for court costs, expenses and losses incurred, as well as amounts paid to third parties for the infringement of exclusive copyright and other intellectual property rights, and other losses incurred by the Publisher due to the Author's failure to comply with the guarantees provided by them under this Agreement.

10.3. In accordance with Art. 6 of the Federal Law "On Personal Data" No. 152-FZ of July 27, 2006, during the period from the conclusion of this Agreement until the termination of the Parties' obligations under this Agreement, the Author consents to the processing by the Publisher of the following personal data of the Author: surname, first name, patronymic; individual taxpayer identification number (INN); date and place of birth; information on citizenship; details of identity documents; addresses of registration and actual residence; email addresses; mailing address with postal code; contact phone numbers; fax numbers; information about places of work.

10.4. The Publisher has the right to process the specified personal data for the purposes of fulfilling this Agreement, including providing information and reference services to the Author. Processing of personal data means actions (operations) with personal data, including collection, systematization, accumulation, storage, clarification (updating, modification), use, distribution (including transfer to third parties), depersonalization, blocking, and destruction of personal data in accordance with the current legislation of the Russian Federation.

10.5. The Author has the right to withdraw consent to the processing of personal data listed in clause 10.3 by sending a corresponding notification to the Publisher in cases stipulated by the legislation of the Russian Federation. Upon receipt of such notification, the Publisher has the right to suspend the provision of services.

10.6. The Author voluntarily provides the Editorial Team of the Journal with information about themselves (and about each of the Co-authors - subject to prior agreement with them), including: surname, first name, patronymic, academic degree, academic title, position, place of work (name and mailing address of the organization), work phone number, and email address for their open publication in the Journal along with the publication of the article.
